Float Site's Consent and Release (For All Construction/Deco/Site Volunteer Activities)

Code of Conduct. Our mission is to educate our youth, foster a broader sense of community and to create a positive experience and lifetime memory in the lives of our volunteers by developing, building and decorating a float for the Pasadena Tournament of Roses Parade each year. Each year thousands of hours are donated by hundreds of volunteers who come together to accomplish this goal every year. It is a privilege to be involved with LCFTRA and each volunteer should reflect positivity within the broader community when acting on our behalf.
LCFTRA is committed to sustaining a positive, safe and productive work environment for all our members and volunteers. Our members and volunteers need to set the example for appropriate behavior for our community. All members and volunteers agree that they will, while at the sites or volunteering for LCFTRA:

1. Treat all volunteers with respect and understanding.
2. Act as a role model for the hundreds of young people who view, visit or support our organization. 3. Appreciate everyone's contribution.
4. Not participate in any form of sexual harassment, sexual misconduct or unwanted physical contact with another person.
5. Not use controlled substances of any kind.
6. Not engage in the unauthorized consumption or storage of alcohol at the sites. 7. Not be verbally abusive or offensive, including using angry, demeaning or vulgar language or swearing or bullying.
8. Not engage in theft or intentional destruction or loss of property.
9. Not engage in conduct unbecoming the long-term health of LCFTRA.
10. Follow all Decorating Site Rules

Risks. I wish to, or may wish in the future, perform volunteer construction and decoration of a float being entered in future Pasadena Tournament of Roses Parades ("Activity" or "Activities") by the La Cañada Flintridge Tournament of Roses Association (LCFTRA). I understand that some of the Activities may be hazardous and may involve risk of personal injury. In particular, I realize that the Activity possibly involves climbing upon and working around scaffolds and frames from which I may fall or be struck by falling objects. It also involves work with sharp objects and flammable or hazardous materials. Furthermore, I realize that the treatment of such injury is not covered by any medical insurance policy provided by the LCFTRA or any other organization in charge of construction, decorating and/or transporting the float.

Medical Consent. In the event that I should suffer any injury or illness requiring immediate medical attention while working on the float and Activities, the LCFTRA, or any of its officers, directors, members, agents, or assigns, have my consent and permission to obtain medical care and treatment for me (or my child) on my behalf. This consent extends to any doctor, dentist, nurse, paramedic, hospital or other persons or entities qualified and trained to treat such injury or illness in such manner as in their judgment and discretion is deemed necessary or advisable under the circumstances at such time. I will be responsible for the cost of such care or treatment.

Agreement Not to Sue. In consideration for permitting me to work on the construction and decoration of the La Cañada Flintridge Rose Parade float, I agree not to sue or press any claim against the LCFTRA, or any of its officers, directors, members, agents, assigns or employees, for any injury to myself or damage to my property, as a result of, or arising out of my work on the float – even if such injury or damage is due entirely to the negligence of the LCFTRA, or any of its officers, directors, members, agents, assigns or employees, or to the condition of the float or the property upon which it may be located.
Consent to Photography and Publicity. I understand and consent to my and my children or dependents being photographed or videotaped for educational, training, research, curriculum, marketing, publicity or similar purposes including posting on social media sites such as Facebook, Twitter, Instagram and similar online locations.

This Agreement constitutes the sole and entire agreement of LCFTRA and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. This Agreement is binding on and shall inure to the benefit of LCFTRA and me and our respective successors and assigns. All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule whether of the State of California or any other jurisdiction.

I hereby waive California Civil Code §1542 that states:
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
In consideration for permitting myself or my child to work upon the construction and decoration of the float being entered in a Pasadena Tournament of Roses Parade by the LCFTRA, I, on behalf of myself and/or my child, agree to all the terms noted in the above agreement.
